The petitioners are aggrieved by the delay in disposal of their prayer for renewal of the recognition of the Chuadanga Junior High Madrasah at Hoshnabad, District-Paschim Medinipur.

The Secretary of the West Bengal Board of Madrasah Education, the respondent no. 4 herein by his order bearing Memo No. 182/Law/R.O.09/ dated May 18, had deferred consideration of the said prayer of the petitioners to have the opinion of the recognition committee of the West Bengal Board of Madrasah Education.

During the pendency of the writ petition, the respondent no. 4 by his order dated July 17, 2023 bearing Memo no.188/Law/R.O.09/2023 has rejected the said prayer of the petitioners for renewal of the recognition of the said Madrasah.

Mr. Ali, learned Senior advocate for the petitioners though sought to impeach the legality and propriety of the said order dated July 17, 2023 but such challenge is beyond the scope of the instant writ petition as such does not deserve consideration.

However, it is open to the petitioners to challenge the said order in accordance with law.

Mr. Ali complains that no hard copy of the said order July 17, 2023 is served upon his clients, only the soft copy of it was sent to the registered e-mail ID of the Madrasah.

Mr. Nadeem Sulaiman, learned advocate for the Board files a copy of the said order, let it be kept with the record. He also supplies a copy of it to Mr. Ali.

The main grievance of the petitioners since has been addressed, no further order(s) need be passed in the matter.

W.P.A. 13816 of 2023 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
