Although proper service has not been completed on all the private respondents, the matter is taken up for hearing, as the prayer of the petitioner is innocuous.
Learned counsel for the petitioner submits that a parallel writ petition has been filed by the petitioner, which is pending in this Court before a different Bench.
Accordingly, the petitioner seeks to withdraw the present writ petition with liberty to pursue his cause of action before the other Bench in the other matter.
Accordingly, WPA No. 13822 of the 2023 is dismissed as withdrawn, with liberty to the
petitioner to pursue the same cause of action in the other pending writ petition.
It is made clear that the merits of this writ petition have not been gone into by this Court and the petitioner will be at liberty to canvass his grievances before any other court / legal forum. There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
