Md Noor Alam & ANR v. State Of West Bengal
06-01-2025 (ct. no. 29) KOLE CRAN 3 of 2024 in CRM 4881 of 2017 In re: An application for relaxation of condition of bail under Section 439(1)(b) of the Code of Criminal Procedure/Section 483(1)(b) of the BNSS - A n d - In the matter of : Md. Noor Alam & Anr.
.... Petitioners.
Mr. Bibaswan Bhattacharyya, Mr. Sahid Uddin Ahmed, ... for the petitioners.
Mr. Puja Goswami, .... For the State.
IN Re: CRAN 3 of 2024 1.
The petitioners were granted bail by a Coordinate Bench on June 1, 2017. The conditions of bail were that the petitioners shall appear before the learned Trial Court on every date of hearing and shall not leave the city of Kolkata except for attending court proceedings and shall furnish their place of address to the Officer-inCharge of Domjur Police Station and the learned Trial Court. 2.
The petitioners moved an application being CRAN 397 of 2018 for relaxation of the conditions of bail. A Coordinate Bench modified the condition of bail and directed the petitioners to meet the officer in charge of Domjur Police Station once in a week until further orders. The other conditions of bail were, however, directed to continue.
3.
A further application being CRAN 2 of 2019 was moved by the petitioners for further relaxation of conditions of bail. By an order dated February 3, 2021, a Coordinate Bench directed the
petitioners to meet the Officer in Charge, Domjur Police Station once every fortnight.
4.
Now, the petitioners have again come before us saying that the requirement of reporting to the Officer in Charge, Domjur Police Station may be waived.
5.
Learned State Advocate files a report from which we find that the petitioners have been adhering to the conditions of bail scrupulously. In that view of the matter and considering that even charge has not been framed, we are inclined to allow the petitioners' prayer.
6.
Accordingly, the requirement of the petitioners reporting to the Officer in Charge of Domjur Police Station stands waived. The other conditions of bail shall, however, remain operative. 7.
CRAN 3 of 2024 is, thus, disposed of.
8.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. ( Apurba Sinha Ray, J. ) ( Arijit Banerjee, J. )
