...for the petitioner This application under Article of the Constitution of India is at the instance of the husband/petitioner praying for a direction upon the learned Additional District Judge, 3rd Court at Barrackpore, District-North 24-Parganas to dispose of Matrimonial Suit No.2635 of 2021 expeditiously. The learned advocate appearing for the petitioner submits that the application under Section 24 of the Hindu Marriage Act filed by the wife/opposite party herein was disposed of by an order dated May 2, 2024 and the petitioner is paying maintenance in compliance with the said order. He further submits that the matrimonial suit is at the evidence stage and August 1, 2025 has been fixed for further evidence of P.W. 1. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the

opposite party or the learned advocate representing the opposite party before the learned trial judge. From the order sheets appended to this application, this Court finds that August 1, 2025 has been fixed for further evidence of P.W.1.

In view thereof, CO 2174 of 2025 stands disposed of by requesting the learned Additional District Judge, 3rd Court at Barrackpore, District-North 24-Parganas to make an endeavour to see that the Matrimonial Suit No.2635 of 2021 is disposed of as expeditiously as possible provided the husband/petitioner is not in default in payment of alimony and maintenance. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
