The petitioner has already canvassed his point with regard to the provisions of Sections 328/329/330 of the Code of Criminal Procedure. An application dated 01.02.2022 was filed by the next kin in connection with complaint case No. C150 of 2021. I direct the learned Judicial Magistrate, 6th Court, Howrah to reconsider the said application and if required, constitute a Board of Doctors from the appropriate department of SSKM Hospital, Kolkata. The learned court would after receiving the report from the Board of Doctors, decide the further course of action.

It has been informed that the next date has been fixed on 22.06.2023 before the learned Judicial Magistrate, 6th Court, Howrah.

The learned Judicial Magistrate, 6th Court, Howrah would on 22.06.2023 or within a week thereafter dispose of the application in terms of the directions made above. With the aforesaid observations, the revisional application being CRR 2137 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
