The Panchayat is not represented despite service. Learned counsel for the petitioner submits that the private respondent is raising construction in violation of the order passed by the Executive Magistrate in MP Case No. 182 of 2025 on February 06, 2025.

Learned counsel for the private respondent takes this Court to an order of injunction passed by the learned Civil Judge (Junior Division), Dubrajpur, Birbhum on September 01, 2025 in a suit filed by the private respondent against the petitioner wherein the learned Civil Judge has restrained this petitioner from creating disturbance in the construction work of the private respondent in respect of the property in question till disposal of the suit. Learned counsel submits that the construction is going on in terms of the said order. Moreover, the MP Case filed by the petitioner has been

dropped and the order passed therein has lost its force after expiry of the statutory period of time. In the event the petitioner alleges violation of the order of any Court by the private respondent, he is at liberty to approach the appropriate forum for redressal of his grievance. Since the petitioner has no other allegation against the private respondent herein, the writ petition is devoid of any merit and is accordingly dismissed. There shall, however, be no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
