Ms. Manisha Sharma ....for the State Petitioner seeks anticipatory bail.

Learned advocate appearing for the petitioner submits that the complaint against the petitioner is without any basis. The marriage took place in 1995. Petitioner is an employee of the Railways. He constructed a house and thereafter requested the defacto complainant and the children to move to the newly constructed house whereupon the disputes arose. State is represented.

Considering the facts and circumstances of the case and the materials available in the Case Diary, we are inclined to grant anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further conditions that the petitioner shall meet the investigating officer once in a month until further orders and shall appear before the jurisdictional court and pray for regular bail within a period of four weeks from date.
