The petitioner has initiated a proceeding under the Guardian and Wards Act, 1890 being Act VIII Case No. 187 of 2019 pending before the learned District Judge, Alipore.

The petitioner complains delay in disposal of an application filed by him in the said proceeding praying for an appropriate order of injunction restraining the opposite party from removing his minor daughter from his custody forcefully.

He prays for a direction upon the learned Trial Judge for expeditious disposal of the said application.

It appears from the record that the opposite party is yet to appear in the said proceeding, however, in view of the nature of the said application, the learned Trial Judge is requested

to dispose of the said application in accordance with law, expeditiously, preferably within three available effective working months of the said Court from the date of communication of this order and in doing so, shall not grant any unnecessary adjournment to either of the parties. C.O. 1619 of 2021 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
