Pratik Bhattacharya sg Ct. 6 [ Mr. Dinendra Nath Chatterjee ...for the petitioners The learned Advocate appearing for the petitioners submits that after dismissal of the suit for default, the petitioners filed a Misc. Case being No. 5377 of 2024 under the provision of Order 9 Rule 9 of the Code of Civil Procedure, which is pending before the learned Judge, 10th Bench, City Civil Court at Calcutta.

The learned Advocate for the petitioners further submits that the 11th August, 2026 is fixed for filing of written objection to the application under Section 5 of the Limitation Act in connection with the aforesaid Misc. Case. He submits that a direction be passed upon the learned Civil Judge to dispose of the Misc. Case as expeditiously as possible.

In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioners shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith.

In the light of the submission made by the learned Advocate for the petitioners, this civil revisional application stands disposed of by requesting the learned Judge 10th Bench, City Civil Court at Calcutta to make an endeavour to

dispose of the Misc. Case No. 5377 of 2024 as expeditiously as possible but preferably within a period of six working months from the next date fixed without granting any unnecessary adjournments to either of the parties Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requite formalities.
