30-06-2023 (ct. no.06) debajyoti CRM (A) 2372 of 2023 In re: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Balurghat Police Station Case No.390 of 2023 dated 1505-2023 under Sections 21(c)/22(c)/23(c)/25/27A/ 28/29 of the Narcotic Drugs and Psychotropic Substances Act.

- A n d - In the matter of : Ramen Debnath alias Ramen Devnath .... Petitioner.

Mr. Sayan De, Mr. Sayan Kanjilal ... For the Petitioner.

Mr. Rudradipta Nandy, learned APP, Mr. Subrato Roy ... For the State.

The petitioner prays for anticipatory bail. The charge is under Sections 21(c)/22(c)/23(c)/25/27A/ 28/29 of the Narcotic Drugs and Psychotropic Substances Act. The petitioner says that he has nothing to do with the matter. Nothing was recovered from him. He has been implicated on the basis of statement made by co-accused. We have gone through the material in the Case Diary. It appears that the contraband was in a Toto. When the police intercepted the Toto, the petitioner ran away. Considering the material on record and the nature of the allegation as well as possible extent of complicity of the petitioner in the alleged crime, we are not inclined to extend the privilege of anticipatory bail to the petitioner.

The application for anticipatory bail being CRM (A) 2372 of 2023 is dismissed.
