Rahman Mr. Amit Ganguly ..for the petitioner This application under Article 227 of the Constitution of India is at the instance of the employer and is directed against an order being no. 50 dated 7th March, 2025 passed by the learned Judge, 7th Industrial Tribunal, Kolkata in Labour Case No. 01 of 2018.
By the order impugned the prayer of the petitioner for appointment of a handwriting expert for verification of the signature of Radhey Shyam Jaiswal as appearing in exhibit 4 stood rejected.
The petitioner herein has not disputed the said document in the pleadings. The document in question was marked as exhibit 4 in the presence of the petitioner without any objection. That apart the admitted signature of Radhey Shyam Jaiswal has also not been produced before the learned Tribunal for comparison.
For such reason, this Court is of the considered view that the learned Judge, 7th Industrial Tribunal, Kolkata was right in rejecting the said application.
This Court does not find any infirmity in the order impugned warranting interference under Article 227 of the Constitution of India.
Accordingly, C.O. 2178 of 2025 stands dismissed. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
