Dulal Chandra Mondal & ANR v. Nemai Chandra Pramanick & ORS
19.12.2023 Srimanta Sl. No. 04 Ct. No. 655 CO/1985/2015 Dulal Chandra Mondal & Anr.
-Vs.- Nemai Chandra Pramanick & Ors.
Both parties are not represented.
It appears that the instant revisional application is preferred challenging the impugned order dated 27.02.2015 whereby learned Trial Court allowed the application filed by the appellants under Order 26 Rule 9 of the Civil Procedure Code and appointed a survey passed Advocate Commissioner for the purpose of holding local investigation in respect of the scheduled properties. Being aggrieved by and dissatisfied with the said impugned order the instant revisional application is filed by the petitioners and is pending since the year 2015.
So, there is reasonable ground to believe that the petitioners have lost their interest to proceed with the present application. Accordingly, the revisional application being CO/1985/2015 is hereby dismissed for default.
Interim order, if any, stands vacated.
There will be no order as to costs.
