The order dated 14.02.2023 reflects that the learned Judicial Magistrate, 2nd Court, Uluberia was pleased to impose conditions that the main accused person would meet with the investigating officer once in a month and cooperate with the investigation.

Mr. Ganguly, learned advocate appearing for the petitioner submits that the petitioner viz Madhusudan Ghosh is available and he has been complying with such condition although he is a regular resident of Jamnagar, Gujarat. Mr. Roy, learned advocate appearing for the State submits that there is nothing on record to suggest that the petitioner has violated the conditions.

Accordingly, in connection with Bagnan police Station Case No.289/2018 dated 28.07.2018 the present petitioner viz Madhusudan Ghosh would meet with the investigating officer of the case once in a month virtually. If the investigating officer issues any notice, the petitioner would take efforts for making himself available virtually at least within a period of

24 hours. If physical appearance of the petitioner is required, the investigating officer would be at liberty to take direction from the learned Judicial Magistrate, 2nd Court, Uluberia. In such case the petitioner would make himself available before the investigation officer within a reasonable period of time. With the aforesaid observations, CRM(SB) 112 of 2023 is disposed of.
