3. In pursuance of the direction passed by this Court report is submitted by the Learned Registrar Administration (L & OM) along with a report submitted by Santipur Police, District- Nadia indicating that the sole appellant/ convict Babu @ Pratap Das, S/o Late Tetul Chandra Das resident of Village-Shyamchand Road, Santipur, Ward No.3, P.O. & P.S. Santipur, Nadia has expired during the pendency of this appeal. A certificate of death of the said appellant was collected by the concerned P.S. which also supports the death of Babu @ Pratap Das.

4. Due to the death of the sole appellant convict Babu @ Pratap Das, the instant appeal stands abated against him.

5. Accordingly, the appeal being CRA 330 of 2015 is hereby dismissed as abated.
