Roy Mr. Sutanu Chakrabarti ... for the State-respondent(s) Mr. Prithwiraj Biswas ... for the private respondent(s) Re The petitioner is aggrieved by the fact that he is unable to enjoy his land and/or cultivate his property as the private respondents have been continuously disturbing and threatening him. To that effect, informations were furnished before the police authorities and subsequent to which a case has already been initiated being Complaint Case No. 132 of 2023.

The police authorities have submitted a report wherein it reflects that there is a long standing dispute over a

land between the petitioner and the private respondents.

Having regard to the fact that the police authorities have drawn up a proceeding under Sections 107/116(3) of the Cr.P.C. at the relevant point of time and they have been keeping a strict vigil, I am of the opinion that so far as the right to cultivate is concerned, the same would be decided by the jurisdictional civil court, the police authorities have hardly any role to involve themselves.

Learned advocate for the private respondent nos. 4 and 5 is present and disputes and denies the contentions advanced in the writ petition.

Having regard to the observations made above, further interference is uncalled for.

With the aforesaid observations, WPA 13736 of 2025 is disposed of.
