Mr. Zothanpuii Varte, Ms. Jonaki Saha ... for the defacto complainant Learned counsel for the victim says that on the date of incident the victim was minor and the petitioner took her a hotel where she was physically abused.

Learned counsel for the State submits that victim was 17 years 11 months as on the date of incident and had turned major as on the date of application.

Learned counsel has also submitted that victim did not agree for the medical examination. It has also emerged during the course of submission that victim in her statement under Section 164 Cr.P.C.

submitted that she was in relation with the petitioner and initially petitioner agreed to marry her but later on refused. Charge sheet has already been filed. Thus, taking into the facts and circumstances of this case the petitioner is admitted to pre-arrest bail by furnishing personal bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of like amount each, one of whom shall be local, to the satisfaction of the Investigating Officer, subject to the conditions that he shall not contact the victim in any manner and he shall join and cooperate in the investigation as and when directed by the Investigating Officer and shall not threaten, tamper or intimidate the complainant or members of the family in any manner.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
