The petitioner being the accused filed this application under section 482 of the Criminal Procedure Code, 1973 seeking quashing of the proceedings being G.R. case no. 4918 of 2015, arising out of Bhaktinagar PS case no. 1681/15 dated 29.11.2015 under sections 468/471/409/120B of the IPC pending before the learned Chief Judicial Magistrate, Jalpaiguri.

It appears from the report, during the pendency of this case, after completion of the investigation, the Investigating Officer has filed the final report as mistake of facts vide no. 844/2018 dated 28.10.2018 and the same is pending before the learned court below.

It also appears from the report that the next date is fixed for appearance of the defacto-complainant before the learned CJM, Jalpaiguri on 24.04.2024.

In such circumstances, this application is not requires to keep pending.

Accordingly, CRR 2020 of 2018 is, thus, disposed of with a direction to the learned CJM, Jalpaiguri, to decide the case preferably within two months from the next date of hearing after completion of all processes.

Liberty to approach if the result is negative. Interim order, if any, stands vacated.

Let the order be communicated to the Ld. Court below for information and compliance.
