Petitioner apprehends that he may be dispossessed and as, such, filed a representation before the police authorities.

State has submitted a report. Report reflects that in C.R.1527 of 1986 the Hon'ble High Court was pleased to dismiss the revisional application and the Title Suit being 85 of 2008 initiated at the behest of the present petitioner being the plaintiff was also dismissed as the learned Civil Court (Junior Division), 2nd Court, Basirhat arrived at his conclusion that the reliefs claimed for by the plaintiff do not deserve any interference.

Learned advocate for the private respondent nos.5 to 14 draws the attention of the Court to the judgment delivered by the learned Civil Judge (Junior Division), 2nd Court, Basirhat wherein it has been categorically stated that there was already an order of restoration of possession of the suit land in favour of the defendants/present respondents.

Having considered that the civil court is thick and thin of the issue, I am of the view that the nature of the dispute is absolutely a private dispute, thereby not warranting interference of this Court by invoking the jurisdiction under Article 226 of the Constitution of India.

Accordingly, WPA 13741 of is dismissed.

There will be no order as to costs.

Report so submitted be kept with the record.
