The petitioner is alleging over action by the police in sealing his godown storing plastic toys. The petitioner is not a manufacturer.

The West Bengal Pollution Control Board has directed the Burra Bazar Police Station to ensure that the petitioner's unit does not function without a trade and fire licence.

The petitioner shall be entitled to produce his trade and fire licence before Burra Bazar Police Station. Upon production of such valid licences and the Burra Bazar Police Station shall unseal the petitioner's premises.

If, however, the petitioner is of the view that he is not required to have a fire licence, he may approach the Pollution Control Board to take steps in accordance with law.

With the aforesaid directions, the instant writ petition shall stand disposed of.

Copies of the orders of the Pollution Control

Board, as produced by the Counsel for the State dated 19th August, 2020 and the communication dated 27th July, 2021 addressed to Burra Bazar Police Station are taken with the record.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
