This application under Article 227 of the Constitution of India is at the instance of the wife praying for a direction upon the learned Additional District Judge, 1st Court, Sealdah, South 24 Parganas to dispose of Matrimonial Suit No.236 of 2019 expeditiously.

The learned advocate for the petitioner submits that the opposite party herein is taking several adjournments in the matrimonial suit and repeated dates have been fixed for evidence of the husband/ opposite party, but till date the evidence of the husband/opposite party has not started.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite party.

However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or upon the learned advocates representing him before the learned Trial Court.

From the order-sheet appended to this revisional application, this Court finds that on August 29, 2024, the miscellaneous case under Section 24 of the Hindu Marriage Act was disposed of. Thereafter, dates were fixed for evidence of the husband/opposite party herein. The last date was fixed on June 10, 2025 for evidence of the husband/opposite party herein. The learned advocate for the petitioner submits that the next date for evidence of the husband/ opposite party herein has been fixed on July 28, 2025. In the light of the submission made by the learned advocate for the petitioner, C. O. No.2183 of 2025 is disposed of by requesting the learned Additional District Judge, 1st Court, Sealdah, South 24 Parganas to make an endeavour to dispose of the Matrimonial Suit No.236 of 2019 as expeditiously as possible but preferably within a period of one year from the next date fixed.

This order has been passed considering the fact that the suit is a matrimonial suit pending since 2019 and the same is at the stage of evidence.
