Pursuant to an earlier order of this Court, the SubDivisional Officer, Diamond Harbour being the respondent No. 6 has filed a report inter alia, highlighting that there is illegal construction. It is submitted on behalf of the State that the grievance of the petitioner be referred to the respondent No. 6. In view of the submissions of the parties, I direct the respondent No. 6 to consider and dispose of the representation made on behalf of the petitioner within a period of six weeks from date after giving all affected parties a right of hearing. The respondent No. 6 will not be bound by any observation made in this order on the merits of the case.

With the aforesaid directions, W.PA. 12781 of 2019 is disposed of.

There will be no order as to costs.

The respondent No. 6 is directed to communicate his reasoned decision to all the parties within two weeks from the date of taking the said decision.

Photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
