Amit Agarwal & ORS v. State Of West Bengal & ANR
24.06.2024 Sl.No. 26 Ct. 32 Amalranjan In The High Court At Calcutta Criminal Revisional Jurisdiction Appellate Side CRR 1805 of 2017 Sri Amit Agarwal and ors.
Vs.
The State of West Bengal and anr.
Nobody appears on behalf of either of the parties on call. Even on earlier occasion no one represented the petitioners, no accommodation sought.
This is an application pending since 2017.
Upon perusal of the record it appears that the petitioners have obtained stay order from this court. At the time of passing interim order, the petitioners were directed to serve the revisional application along with the copy of the order upon the opposite parties within a week from date and to file affidavit of service to such effect on the next date of hearing.
In spite of such direction, no one appears to show that the copy has been served upon the opposite parties. Under such circumstances, this court finds that the petitioners are no more interested to proceed with the instant case.
Accordingly, CRR 1805 of 2017 is dismissed as nonprosecution. Interim order, if any, stands vacated.
Let the order be communicated to the Ld. Court below for information.
Liberty is granted to all parties to act in terms of the copy of this order downloaded from the official website of this court.
Urgent Photostat certified copy of this order, if applied for, be supplied to the parties taking all legal formalities. ( Ajay Kumar Gupta, J. )
