The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with.

The petitioner is the plaintiff in a suit for partition being Title Suit No. 844 of 1996 pending before the 1st Court of the learned Civil Judge (Senior Division) at Barasat, District : 24Parganas (North). The suit has been decreed in preliminary form. The petitioner is complaining delay in making the said preliminary decree in final form and is praying for a direction for expeditious disposal of it.

It appears that the suit is at a very matured stage, the learned Trial Judge therefore is requested to bring the same to its logical conclusion as expeditiously as possible in accordance with law, if it is otherwise ready for such disposal and in doing so, shall not grant any unnecessary adjournment to either of the parties. C.O. 1977 of 2024 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
