Mr. Mobaidur Hossain ...for the petitioners Mr. Tapan Kumar Mukherjee Mr. Somnath Naskar ...for the State The petitioners are working as Anganwari Helpers (AWHs) in the Nowda, ICDS Project, Murshidabad. A notice was published on December 6, 2022. Vacancies were advertised for engagement of 35 AWWs (Anganwari Workers). The AWHs, who were working continuously for a period of five years without break in service, were eligible for such engagement. The petitioners participated in the selection process. They appeared in the written test on April 8, 2023. They appeared for viva voce on May 2, 2023.

Thereafter, a panel was prepared by the District Programme Officer (DPO), Murshidabad on May 17, 2023 of 26 eligible candidates. The petitioners' names were not there in the said panel. The petitioners made a representation to the Child Development Project Officer (CDPO) on May

22, 2023. The grievance of the petitioners is that such representation has not been considered till date.

Considering the submissions of the parties and the materials placed on record, this Court directs the CDPO to consider the representation of the petitioner by 8(eight) weeks from date and pass a reasoned order thereon. Such reasoned order shall be communicated to the petitioners within two weeks of passing thereof.

With the directions aforesaid, WPA 13871 of 2023 is disposed of.

Since affidavits have not been invited in the present writ petition, the allegations made in the writ petition are deemed not to have been admitted by the parties.
