Saha ... for the petitioner This application under Article of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Civil Judge (Junior Division), 5th Court at Alipore to dispose of Title Suit No. 1772 of 2017 expeditiously.

From the order-sheets appended to this application this Court finds that 27th October, 2025 has been fixed for service returns upon the defendant no.2. Thus it appears that the suit is not yet ready for hearing. For such reason, this Court is not inclined to pass any direction for expeditious hearing at this stage. With the above observations and directions, C.O. 2189 of 2025 stands disposed of.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
