1. Heard the learned Counsel for the parties. Charge-sheet is stated to be filed.

2. Learned counsel for the petitioners does not want to press this application for anticipatory bail in respect of petitioner no.1 Pintu Malo on the ground that he has already been arrested.

3. Accordingly, this application for anticipatory bail is dismissed as not pressed in respect of petitioner no.1 Pintu Malo.

4. Charge-sheet is stated to be filed. The injury report shown before us by learned counsel for the State does not speak of any serious injury.

5. Regard being had to such facts and submissions, factum of permanent residence of the petitioner no.2 Paban Malo

and completion of investigation, it is directed that the petitioner no.2 shall appear before the learned ACJM, Chanchal, Malda in G.R. Case No.811 of 2023 within 15 days from today. In the event of his appearance and application for bail, petitioner no.2 shall be released on bail on such terms and conditions as deemed just and proper in the facts and circumstances of the case.

6. Accordingly, the prayer for the anticipatory bail in respect of petitioner no.2 is allowed.

7. The application being CRM(A) 2386 of 2023 is disposed of.

8. The learned ACJM, Chanchal, Malda is hereby directed to act upon the server copy of this order.
