Petitioner is aggrieved by the fact that on or about 04.08.2025 Court No. 35 M/L. No.644 Rakib 14.05.2024 information was furnished to the Inspectorin-Charge of Baruipur Police Station as well as Superintendent of Police, Baruipur Police District. The main grievance of the petitioner was that at the time of demolition of his restaurant information was sent to the police authorities but no proper steps were taken, consequent to which there has been demolition of whole of the property of the petitioner.

On the other hand learned advocate appearing for the State submits that investigation commenced on the basis of Baruipur PS case no. 1156/24 under the relevant provisions of BNS.

Having considered that the police authorities have registered a case but the petitioner has finally suffered loss because of demolition of the property. In case, the petitioner is aggrieved of the outcome of the investigation, petitioner would advance the prayer under Section 111 of the BNS, learned Magistrate in seisin of the case would assess the same and pass necessary directions. So far as

the other issues are concerned, petitioner would be at liberty to approach the appropriate forum for compensation by way of damages. In case such situation still persists, police authorities would ensure regarding the peace and tranquility of the area.

With the aforesaid observations WPA 14947 of 2024 is disposed of.
