Ms. Rima Das ... for the respondent no. 10 The writ petitioner is aggrieved by a notice dated 26th August, 2021 issued by the Assistant Engineer, PWD, Berhampore, Sub-Division-III, asking him to remove unauthorised encroachment on government land of Plot No. 2198 of Mouza & JL No.-Islampore 56, P.S-Islampur, Murshidabad. The petitioner has set up a temporary shop on government land for a fixed time in the day.

Learned counsel for the petitioner submits that his client should not be evicted.

This Court notes that the plot of land admittedly belongs to the PWD, and the writ petitioner has no right, title and interest thereon. In that view of the matter, no relief can be granted to the writ petitioner.

The writ petition is dismissed.

There will be no order as to costs.
