Re: CAN 2 of 2022 This is an application seeking disposal of the instant appeal on the basis of the terms of settlement entered upon between the parties to the proceeding. The copy of the Memorandum of Understanding and the deed for reconstruction of the partnership firm signed by all the parties to the proceeding are annexed to the instant application; wherefrom it appears that the parties have amicably settled the disputes between them.

Learned Advocate appearing for the respondent submits that since the settlement has been arrived, his client has no objection if the instant appeal is disposed of in terms of such settlement.

In view of the above, the instant appeal is disposed of on the basis of the terms of settlement annexed to the instant application as Annexure P-1 and P-2 thereof.

Let those settlements be form part of the instant order.

The connected application is accordingly disposed of.
