Petitioner is aggrieved by the fact that although investigation commenced in connection with Frezergunj Coastal Police Station on or about 01.05.2024, no steps have been taken.
On the other hand learned advocate for the State submits that the investigation has been concluded and charge-sheet has been submitted before the jurisdictional Court.
Learned advocate for the private respondents submit that civil case is pending and the nature of complaint which has been advanced has a flavor of civil dispute.
Be that as it may, since the petitioner is aggrieved by the process, progress and outcome of the investigation, petitioner would be at liberty to approach the jurisdictional Magistrate by taking out an appropriate
application. If petitioner is aggrieved by the outcome of the investigation, learned Magistrate would assess and ascertain regarding the drawbacks of the materials collected by the investigating authorities and thereafter pass necessary directions as he deems fit and proper. With the aforesaid observations WPA 15009 of 2024 is disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
