Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is eligible to run D.El.Ed and B.Ed course institution. In fact, it had been imparting such education. It had made a representation before the NCTE for recognition. However, it had to pray for postponement of inspection that was to be done by the NCTE. Instead of affording further opportunity, the NCTE decided not to grant affiliation to the institution by an order passed in 2017. The Appellate Authority confirmed the order of rejection.
Learned counsel appearing on behalf of the University submits that it is an old matter and next session for which an Institution can apply for affiliation is for the session of 2024-2026.
In view of the above, it would be a futile exercise to deal with the rejection order of 2017.
It is also a fact that when the NCTE had asked the Institute to have its facility inspected, the latter had prayed for postponement.
Be that as it may, the petitioner Institute shall be at liberty to make a further representation to the NCTE for granting recognition for the session 2024-26 and onwards, upon receipt of which the NCTE shall conduct necessary inspection and consider the representation within a short time and in accordance with law.
With these observations, the writ petition is disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
