For the State Learned counsel for the petitioner is aggrieved by the fact that in spite of informing the Officer in Charge of the Hooghly Cyber Police Station by a communication dated 16th May, 2024 no steps were taken by the police authorities.
A report has been sent which is dated 13th June, 2024. The report reflects that general diary was registered. However, no police case was registered. The petitioner contends that cognizable offence has been committed in terms of the Information and Technology Act, 2000 as the pictures which have been uploaded do intrude the privacy of the petitioner. Having considered the fact that the police authorities are unable to present a clear picture in respect of the steps taken, I direct the petitioner to request for fresh information from the police authority regarding the progress and steps taken. In case till date no case has been registered and according to the petitioner cognizable offence has been made out, in that
case the petitioner shall approach the jurisdictional Magistrate under the relevant provisions of law. The jurisdictional Magistrate would assess and ascertain regarding the genuinity of the allegation and thereafter if the learned Magistrate is of the opinion that a case is made out, then the same be directed to be acted upon through the Cyber Crime Police Station, Hooghly Rural District.
With the above observations, the writ petition being WPA 15056 of 2024 is disposed of.
Report submitted by the State be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioner.
