Heard learned counsels for the parties.

It is submitted on behalf of the petitioner that her land comprising residential building was acquired by the State authorities for extension of NH-60 and the residential building was demolished for the purpose.

The State authorities assessed compensation payable to the petitioner to the tune of Rs.7 lakhs initially and after filing of the present writ petition, the authorities undertook to pay compensation of Rs.24 lakhs without disclosing the basis of such assessment.

The petitioner submits that in view of the market value of the land in the vicinity at the material time, the said compensation ought to be Rs.39 lakhs.

The petitioner submitted a representation/objection before the competent authority ventilating his grievance which was received by the latter on 23rd August, 2021. The said representation is yet to be disposed of. The petitioner prays for direction upon the concerned authority to consider the representation at the earliest.

Upon consideration of the submissions made on behalf of the parties and material on record, the writ petition is disposed of directing the respondent No.2 to consider and dispose of the said representation received by the authority on 23rd August, 2021, within a period of two months from the date of communication of this order, after affording reasonable opportunity of hearing to all the interested parties including the petitioner, in accordance with law.

The order should be communicated to the petitioner within a week thereafter.

With the above observations and directions this writ petition WPA 14795 of 2021 is disposed of.

However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
