1. Heard learned Counsel for the parties.

2. 840 litres of ID liquor is stated to have been seized from the possession of one Buddhadeb Ghosh, co-accused. On the basis of statement of the aforesaid co-accused, the present petitioner is stated to have been implicated.

3. It is fairly submitted at the Bar that there is no record of past criminal antecedent against the petitioner.

4. Regard being had to the stage of enquiry, which has progressed substantially, factum of permanent residence of the petitioner and nature of offence, it is directed that the petitioner shall be released on bail by the Arresting Officer of the Excise Department in the event of his arrest in the aforesaid case on such terms and conditions as deemed just and proper in the facts and circumstances of the case.

5. Accordingly, the prayer for the anticipatory bail is allowed.
