Ms. Sabita Khutia (Bhunya), learned Counsel for the petitioner submits that the writ petition suffers from formal defect inasmuch as it has been filed by the husband of the deceased teacher instead of the son, the nominee. She prays leave to withdraw the present writ petition with liberty to file afresh.

W.P.A. 13916 of 2023 is, therefore, dismissed as not maintainable without any order as to costs. This order will not prevent the son of the deceased teacher, the nominee to apply for the selfsame relief.
