Petitioner claims that by falsely impersonating himself, respondent no. 8 entered the flat of the petitioner and proclaimed himself to be the recovery agent of respondent no. 7 (Bank of Baroda), Madhyamgram Branch. Being aggrieved by the highhandedness of the respondent no. 8, petitioner approached the Bank when the Bank did not recognize the respondent no. 8 thereafter petitioner addressed a communication to the police authorities as also the bank authorities.
Be that as it may, State has submitted a report wherefrom it reflects that there is a sum of
Rs. 3,50,000/- transferred from the account of the respondent to the present petitioner.
Having considered that the petitioner has expressed surprise so far as the respondent no. 8 is concerned and the documentary evidence reflecting that the petitioner and the respondent no. 8 are well-known to each other, I am of the view that, for shielding himself from the consequences of the SARFAESI Act, petitioner has approached this Court under Article 226 of the Constitution.
Learned advocate for the Bank of Baroda is present.
Be that as it may, I do not find any reason to interfere so far as the present writ petition is concerned.
Accordingly, WPA 13773 of is dismissed.
