In view of the fact that the charge sheet has been filed on 31st July, 2024, the petitioner shall not be required to meet the I.O. as directed in the order dated 24th June, 2024. It is stated on oath that the learned Additional Chief Judicial Magistrate, Haldia, Purba Medinipur has declined to accept the application for surrender due to lack of jurisdiction.

Under such circumstances, we clarify that the petitioner shall appear before the learned Additional Chief Judicial Magistrate, Haldia instead of Trial Court as mentioned in the order dated 24th June, 2024 within one week from date.

3. With the aforesaid modification, this application is allowed. 4.

CRAN 1 of 2024 is disposed of.

5. Other portion of the said order shall remain unchanged.
