Learned counsel for the petitioner submits that pursuant to an earlier order of this Court granting liberty to the petitioner to file a fresh representation before the police authority for eviction of the private respondent from the property in question, the petitioner submitted a representation on 28th April, 2025 which has not been taken care of.

Learned counsel for the State submits that proceeding under Section 126 of the BNSS has been drawn up pursuant to the said representation.

Learned counsel for the private respondent takes this Court to the representation dated 28th April, 2025 wherein it is stated that the private respondent was given possession of the property by the petitioner's father allegedly for two months but he refused to vacate the property thereafter.

The petitioner is at liberty to take necessary steps before the appropriate forum for redressal of his grievance. No fruitful purpose shall be served by keeping the writ petition pending. The same is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
