The petitioner retired on March 31, 2020 as a Librarian of Bidyabhusan Library at Kolkata.

It is the grievance of the petitioner that there had been some miscalculation of his dues under the General Provident Fund Scheme and resultantly he has not been given his full dues under the said Scheme at the time of his retirement. It is the further grievance of the petitioner that no calculation in support of release of Rs. 59,193/- was provided to him. He made a representation before the respondent authorities for giving him the statement of account of his General Provident Fund amount and also for the interest for belated release of his retiral dues.

Though the State by an order dated June 27, 2023 was directed to file an affidavit disclosing its stand, no affidavit has been filed.

I am not inclined to keep this writ petition pending. Since the disputed facts are involved, I

dispose of this writ petition by directing the District Library Officer, Kolkata to provide the petitioner with the statement of account of his General Provident Fund dues within a period of three weeks from the date of communication of this order.

With regard to interest for delayed payment of retiral dues, the petitioner will be at liberty to file a fresh representation before the Director of Pension, Provident Fund & Group Insurance, respondent no. 4, within a period of two weeks from date. If such representation is made by the petitioner, the same shall be considered by the said authority in accordance with law.

Accordingly, WPA 13922 of 2023 is disposed of. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
