Learned counsel for the petitioner submits that upon the demise of one Kalpita Bose, the petitioner, as brother-in-law and legal heir of the said deceased, is entitled to the amount lying in the account of the said deceased.

Accordingly, the petitioner had applied for disbursal of the amount but has not yet been so paid by the Bank. Learned counsel appearing for the respondent-Bank submits, on instruction, that in view of merger of two branches of the Bank, the concerned documents filed by the petitioner, if any, cannot be located.

Accordingly, if the petitioner files a fresh application along with the required documents, the Bank will immediately process the same and disburse the amounts according to banking norms.

Hence, WPA 13928 of 2023 is disposed of by directing the petitioner to apply in a fresh application

form for disbursal of the amounts standing in the name of the deceased Kalpita Bose in respect of the concerned accounts to the respondent-Bank, along with all necessary documents required to be filed therewith. Upon such application and connected documents being filed by the petitioner, the Bank shall process the same immediately and disburse the account payable to the petitioner, in terms of banking norms, immediately thereafter, positively within a fortnight from the date of such application being made.

The parties shall act on the server copy of this order without insisting upon prior production of a certified copy.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
