It appears from the submissions made on behalf of the parties and upon perusal of the materials on record that at present there is no obstruction in the footpath over the drain.
The petitioner complains that the slabs over the drain have been placed one and half feet above the road level. Due to the height of the drain, there is water accumulation by the side of the drain.
The Chandannagar Municipal Corporation is directed to ensure that there is no water accumulation and the rain and sewerage water can pass off freely from the said drain.
With the above observation, the writ petition stands disposed of.
Exception to the report of the respondent no. 6 filed by the petitioner be retained with the records. The appearance of the learned advocate representing the Chandannagar Municipal Corporation was inadvertently not recorded in the order dated February 22, 2023.
Be it recorded that Mr. Suman Basu, learned advocate represented the Chandannagar Municipal Corporation before this Court on February 22, 2023. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
