The petitioner is the defendant no. 2(b) in a suit for partition and accounts being Title Suit No. 17 of 1996, subsequently re-numbered as Title Suit No. 70 of 2019 pending before the 6th Court of learned Civil Judge, (Senior Division) at Alipore, District - 24 Parganas (South).

The petitioner is complaining inordinate delay in disposal of two applications filed by him for appointment of receiver over the suit properties and is praying a direction upon the learned Trial Judge for expeditious disposal of the said applications. It appears from the record that one application for appointment of receiver was filed in the year 2014, and the other one was filed in the year 2017. The nature of those applications demands their expeditious disposal.

The learned Trial Judge is, therefore, requested to make all endeavour to dispose of the said applications as expeditiously as possible in accordance with law and in doing so shall not grant any unnecessary adjournment to either of the parties.

The petitioner is required to take steps to make the said applications ready for disposal.

C.O. 1641 of 2021 is disposed of with the above terms without any order as to costs.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
