The instant appeal arises out of an order of acquittal dated 31.01.1997 passed by the learned Metropolitan Magistrate, 17th Court, Calcutta in connection with Complaint Case No. C/842/94. In the above premises, the instant appeal is dismissed for nonprosecution. Copy of the order and lower court records be sent to the trial court for due compliance.
