An application for relaxation of bail has been prayed for on behalf of one Sanjiban Sardar who was granted bail on 31.07.2017 in CRM 5113 of 2017. The conditions so imposed while granting bail included, amongst others, that the petitioner "shall not enter the jurisdiction of Kakdwip SubDivision, except for the purpose of attending the trial ........." It has been submitted that father of the petitioner has expired and the religious rites are to be conducted on 10.04.2021. To that effect, the learned advocate for the petitioner submits a communication as well a photostat copy of the card which has been prepared for attending the ceremony. It reflects from the said card that on 12.04.2021
religious rites are to be conducted and the same are to be started from 10.04.2021.
In view of the peculiar circumstances, we modify the earlier condition to the extent that the petitioner shall be permitted to the limited extent for entering in Kakdwip SubDivision for a period of seven days on and from 09.04.2021. The petitioner shall thereafter on 16.04.2021 inform the Officer-in-Charge of Dholahat Police Station before entering the jurisdiction and before leaving the jurisdiction. With the aforesaid observations, the application being CRAN 2 of 2021 is disposed of.
