Affidavit-of-service filed on behalf of the petitioner is taken on record.

By the present writ petition, the petitioner seeks for interest on the revised gratuity disbursed as per ROPA, 2019.

The petitioner contends that he was a Head Teacher of Dumdumi Primary School, Purulia and retired on superannuation on 30th September, 2017. First Pension Payment Order was issued as per ROPA, 2009 on 6th December, 2017 and revised Pension Payment Order was issued as per ROPA, 2019 on 22nd January, 2024. The petitioner has received revised gratuity as per ROPA, 2019 on 18th March, 2024 which was deposited with his bank account. The petitioner has preferred this writ petition claiming interest on the disbursed amount of gratuity from 14th February, 2020 to 18th March, 2024.

Ms. Kaberi Ghosh (Dey), learned Advocate for the petitioner submits that the revised gratuity amount has been deposited to the bank account of the petitioner on 18th March, 2024, however, no interest has been paid by the authority concerned for such delay in deposit. She seeks for interest on the disbursed amount of revised gratuity from the date of notification dated 14th February, 2020 to 18th March, 2024.

Mr. Ananda Dulal Sarkar, learned Advocate appearing for the State also concedes to the fact that although the revised gratuity has been disbursed in favour of the petitioner as per ROPA, 2019, however, interest has not been paid. He files statement of facts dated 14th June, 2024 submitted by the District Inspector of Schools (Primary Education), Purulia.

In view of the above, respondent No.3, the Director of Pension, Provident Fund and Group Insurance and respondent No.4, the Treasury Officer, Purulia are directed to disburse the interest amount on the revised gratuity from 14th February, 2020 to 18th March, 2024 in favour of the petitioner @ 8% per annum within a period of three months from date of communication of this order.

Learned advocate for the petitioner is directed to communicate this order to respondent No.3, the Director of Pension, Provident Fund and Group

Insurance and respondent No.4, the Treasury Officer, Purulia, for necessary compliance.

With the above direction, the writ petition being WPA 15039 of 2024 stands disposed of.

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

10. Interim order, if any, stands vacated.

11. All connected applications, if any, stand disposed of.

12. There shall be no order as to costs.

13. Statement of facts furnished by the District Inspector of Schools (Primary Education), Purulia dated 14th June, 2024 is taken on record.

14. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

15. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
