Mr. Arunangshu Chakraborty Ms. Geniya Mukherjee Mr. Yasraj Ray ... for the petitioner The petitioner has challenged an order dated June 15, 2021 passed by the learned Civil Judge, Junior Division, 3rd Court at Serampore, in Title Suit No. 227 of 2021, whereby an ad interim order of injunction was passed on an application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure. The said order is an appealable one. In view thereof the instant application under Article 227 of the Constitution of India, is not entertained.

The petitioner will be at liberty to approach the appropriate forum against such order. It will also be open to the petitioner to raise the point of maintainability of suit before the proper forum in accordance with law.

Liberty is also given to the petitioner to take back the certified copy of the order impugned upon furnishing a photostat copy of the same.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
