Mr. Maloy Bhattacharya Mr. Subhrojyoti Ghosh ... for the petitioner Ms. Rita Datta ... for the State The present revisional application has been preferred against Order No. 4 dated 15.02.2019 passed by the learned Sessions Judge, Purba Bardhaman in connection with Sessions Case No. 02 of 2019 arising out of Burdwan P.S. Case No. 124 of 2018 dated 21.02.2018 under Section 306 of the Indian Penal Code.

As there is no representation on behalf of the State, Ms. Rita Datta, learned counsel for the State present in Court is appointed to represent the State in this case. Learned PP is requested to regularize her appointment.

It is seen that by the order under revision the trial Court has kept the petition under Section 173 (8) of Cr.P.C. with the record.

It is submitted by the learned counsel for the petitioner that in spite of said petition being not disposed of till date, the trial Court is proceeding with the trial and the petitioner is being seriously prejudiced.

Accordingly, considering the submissions made by the learned counsel for both sides and the materials on record, the learned Sessions Judge, Purba Bardhaman, is directed to dispose of the said application under Section 173(8) Cr.P.C. in accordance with law on hearing both sides positively by February, 2024.

A specific time for disposal of the petition is passed considering the submissions of the learned counsel for the petitioner that the next date for trial is fixed on 07.03.2024. The present revision being CRR 1730 of 2019 is accordingly disposed of.

All connected application, if any, stands disposed of. Interim order, if any, stands vacated.

Let a copy of the order be sent to the learned trial court for compliance.
