Learned counsel for the petitioner argues that despite the quotation amount having been paid by the petitioner, no electricity connection is being given to the petitioner by the West Bengal State Electricity Distribution Company Limited (WBSEDCL).

Learned counsel for the WBSEDCL hands over copies of written objections filed by local people over whose land two electricity poles are required to be erected for giving such connection to the petitioner.

The said objections are kept on record along with the affidavit-of-service.

In view of specific objections having been taken by local people on whose property the electricity poles are apparently required to be installed, the matter is required to be decided on merits by the

concerned District Magistrate, who is the appropriate authority to do so under the Works of Licensees Rules, 2006.

Accordingly, WPA No. 13943 of 2023 is disposed of by granting liberty to the petitioner to approach the respondent no.2 with the grievances ventilated in the present writ petition. Upon such approach being made, the respondent no.2, that is, the District Magistrate, Howrah shall decide the issue in according with law upon giving opportunity of hearing to all concerned and passing a reasoned order at the earliest, positively within six weeks from the date of such application being made by the petitioner.

Parties shall act on the server copy of this order without insisting upon prior production of a certified copy thereof.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
