Ibrahim Khan @ Sk Ibrahim v. State Of West Bengal
07.07.2022.
18.
Ct.No.28 as (Rejected) C.R.M. (DB) 2139 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Garbeta P.S. Case No.123 of 2022 dated 17.03.2022 under Section 379 of the Indian Penal Code and Sections 406/420/409/411/120B and 34 of the Indian Penal Code and Section 467 of the Indian Penal Code and Section 3 of the Prevention of Damage to the Public Property Act.
In the matter of : Ibrahim Khan @ Sk. Ibrahim. ... Petitioner.
Mr. Sankar Nath Mukherjee, Sk. Samim Akhtar, Mr. Nipaj Gupta, Mr. Aditya Biswas.
...for the Petitioner.
Mr. Rudradipta Nandy, ld. A.P.P., Ms. Sonali Das.
...for the State.
Heard the learned Advocates appearing for the parties. Petitioner is in custody for about 50 days. It is contended he has been falsely implicated in the instant case. Stolen eucalyptus trees have already been recovered. Learned Additional Public Prosecutor opposes the prayer for bail. He submits petitioner is the former Prodhan of Karsa Gram Panchayat. He made false entries in the panchayat records and illegally sold large number of eucalyptus trees. We have considered the materials on record. Petitioner is the king pin of the conspiracy to illegally sell public property i.e. eucalyptus trees to various persons. He made false entries in the records to give a colour of authority to such fraudulent transactions. He was the recipient of monies with regard to
illegal sell of eucalyptus trees and number of criminal cases registered against him.
In view of gravity of the offence and the prima facie involvement of the petitioner in the alleged crime, we are of the opinion this is not a fit case to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.
