Mr. Ranabir Roy Chowdhury, Ms. Pushpita Saha ... for the State Learned counsel for the petitioner stated that co-accused Rafikul Shaikh has already been admitted anticipatory bail by the learned Sessions Judge. Learned counsel on parity seeks anticipatory bail of the present petitioner.
Learned counsel for the state has opposed the bail petition on the ground that the present petitioner is a principal offender and he assaulted the victim. I have seen the injury report. Perusal of the record also indicates that it was the petitioner who was the principal offender and assaulted the victim. The parity cannot be brought into play as the role attributed to the co-accused were different.
Taken into the facts and circumstances of this case the petitioner is not entitled to anticipatory bail. Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities. (Dinesh Kumar Sharma, J.)
